Scalding Case Equals $100,000.00

It was just another routine day for John and Jane Smith. They dropped their 5-month-old twin daughters off at their daycare facility and went to work. While Baby Smith was getting her diaper changed, a daycare worker, who was boiling water for the bottles, stumbled, pouring scalding hot water on Baby Smith’s left thigh and foot.

A claim was made against the daycare facility for its negligence in, among other things, placing a changing table in close proximity to a microwave oven used to boil water and for failing to protect Baby Smith from injury while in its charge. The daycare facility, while acknowledging that it was negligent, refused to offer adequate compensation to Baby Smith for her pain, suffering, and permanent disability. The facility claimed that because the accident had happened at such a young age, it was unlikely that she would remember anything about it. Additionally, they claimed that she was totally recovered except for slight scarring in an area of her body that wasn’t easily visible, and her medical bills were less than $1,000.00.

After many months of negotiations that took place on almost a daily basis, the case settled for $100,000.00.
